Terms of service

These terms are the agreement between you, the business that signs up for PageTend, and the company that operates PageTend, named at the bottom of this page ("we", "us"). By starting a plan, paying an invoice, or asking us to make your site live, you agree to them. If anything here is unclear, ask before you start; we would rather explain than argue later.

1. What PageTend is

PageTend is a managed website service. We build your site, register or connect your domain, host the site, keep it secure, and make the changes you ask for. Depending on your plan we also manage your Google Business Profile. You do not get a login, a builder, or a control panel; you send us the change and we make it. That is the product.

2. Plans, what is included, and what is not

Managed website includes the site, hosting, SSL, your domain registration or connection, contact forms delivered to your inbox, hours and holiday updates, unlimited small changes made within one business day, and a short monthly report. A small change is anything you can describe in an email: new photos, a price, a service, your hours, a page of text. Larger work, such as a new page for a second location or moving a site with more than ten pages, is quoted before we do it and only done when you say yes.

Google profile management, alone or bundled with the site, is described on our pricing page and in your order. It includes setting up and correcting your Google Business Profile, keeping hours, services and photos current, posting updates, replying to reviews within two business days using wording you have approved, watching for unwanted edits, and a monthly report. It does not include paid advertising, managing platforms other than Google, photography, removing legitimate negative reviews, or multi-location management. We never write reviews, pay for reviews, or ask only happy customers for them; those practices break Google's rules and can get a listing suspended, and we will decline them.

Response times are targets, not guarantees. We work business days, Eastern time.

3. Fees and billing

Prices are on our pricing page at the time you order and in your order confirmation. Monthly plans are billed in advance each month. Annual plans are billed in advance for twelve months at the discounted annual price. Any one-time fee, such as listing setup, is billed with your first invoice unless it was waived in writing. Prices do not include sales tax where it applies.

We may change prices with at least 30 days' notice by email. A price change takes effect at your next renewal; it never changes a period you have already paid for.

Payment is due on the invoice date. If a payment fails, we will tell you and retry. If a monthly plan is unpaid for 14 days after the due date, we may take the site offline until it is paid. We do not charge late fees, but we do not keep hosting an unpaid site either.

4. Annual plans are non-refundable

Read this section carefully, because it is the one people ask about.

An annual plan is a twelve-month commitment paid in advance in exchange for a lower price. If you cancel an annual plan before the end of its term, the service continues until the end of the term you paid for, and no refund is given for the remaining months, in whole or in part. There is no proration and no credit toward another plan. If you think you may leave within the year, choose the monthly plan; it costs a little more and you can stop it at any time.

Annual plans renew automatically for another twelve months at the then-current annual price unless you cancel before the renewal date. We email a reminder at least 30 days before an annual renewal, and you can cancel the renewal by replying to that email or writing to us any time before the renewal date. A cancelled annual plan simply ends on its renewal date.

Monthly plans have no minimum term. Cancel any time; the plan ends at the end of the month you have paid for, and there is no refund for the remainder of that month.

The one exception in either case: if we end your service for reasons other than non-payment or a breach of these terms, we refund the unused part of any prepaid period.

5. Cancelling and what happens after

You can cancel by emailing us. We confirm the end date in writing. On the end date the site goes offline and forms stop delivering.

Your content is yours. On request, before or within 30 days after the end date, we will send you an export of the text and images on your site at no charge. Your domain stays yours (see section 6). After 30 days we may delete our copy of your site and its content.

We may end your service with 30 days' notice for any reason, with a refund of any unused prepaid period. We may end it immediately, without refund, if you do not pay, if your site is used for anything in section 9, or if you ask us to do something that would break the law or a third party's rules.

6. Your domain

If we register a domain for you, we register it in your name, with you as the registrant, and we hold it in trust for you while you are a client. Renewal is included in your plan. At any time, and in particular when you leave, we transfer the domain to a registrar account of your choosing at no charge, or unlock it for you to transfer; we never hold a domain hostage. If you connect a domain you already own, you keep managing its registration and we only point it at your site.

7. Your content and your Google listing

You own the text, images, logos and other material you give us, and you keep owning them. You give us permission to copy, host, display and adapt them as needed to build and run your site and, if you have that plan, your Google listing. You are responsible for having the rights to what you give us, including photos and testimonials, and for its accuracy. We may decline to publish material we believe is unlawful, infringing, or against a platform's rules, and we will tell you why.

Your Google Business Profile is yours. We work on it as a manager you add and can remove at any time; you remain the owner. We never hold your Google password.

8. Our materials

The PageTend platform, its code, its templates and its design system are ours and stay ours. Your plan gives you the right to have a site built and run on it, not a copy of it. Illustrations and stock photography we place on your site are licensed to us for that use; if you leave, we can tell you which images were yours and which were ours.

With your permission, we may show your site in our portfolio. We never do this without asking.

9. Acceptable use

Your site and listing may not be used for anything unlawful, for spam, for malware or phishing, for content that infringes someone else's rights, for hate or harassment, or for adult content. We may remove such content or end the service under section 5.

10. Availability and support

We host on Cloudflare's network and design for the site to stay up even when our own systems are down. We aim for continuous availability and cannot promise it; brief interruptions for maintenance or from providers outside our control can happen. Support is by email on business days, and we answer within one business day.

11. Third parties

Your site and listing depend on services we do not control: domain registries, Cloudflare, Google, and the email provider that delivers your forms. Their terms apply to their services. We are not responsible for their outages, decisions, or policy changes, though we will do what we can to work around them.

12. No guarantee of results

We build and maintain sites and listings carefully, and we cannot promise search rankings, traffic, calls, reviews, or revenue. Anyone who promises those is guessing.

13. Warranties and liability

The service is provided as is. To the extent the law allows, we make no warranties beyond what is written here, and our total liability to you for anything arising from the service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential losses, such as lost profits or lost business, even if we were told they were possible. Some states do not allow some of these limits; where that is the case, they apply to the extent permitted.

You agree to cover us for claims by third parties that arise from content you gave us or from your use of the service in breach of these terms.

14. Privacy

How we handle information about you and about your site's visitors is described in our privacy policy, which is part of these terms.

15. Changes to these terms

We may update these terms. We will email you at least 30 days before a change takes effect; continuing to use the service after that date is your agreement to the new terms. If you do not agree, you can cancel under section 5, and if the change materially reduces what you paid for, we refund the unused part of a prepaid period.

16. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. If we have a disagreement, we both agree to try to resolve it by talking first. Any claim that cannot be resolved that way may be brought in the state or federal courts located in Hillsborough County, Florida, or in the small-claims court where you are located.

17. Sample sites

We sometimes build a sample site for a business before it has asked for one, using only public information, so the owner can see what a site would look like. A sample is unlisted, is not indexed by search engines, and carries a link that removes it. It creates no obligation on either side.
